1. Definitions

• Student: A user who registers to search for, view, or book accommodation.
• Agent: A landlord, property manager, or authorized representative who lists accommodation.
• Listing: Any apartment, hostel, bed space, self-contained unit, or other accommodation posted on the Platform.
• Booking: A request submitted through the Platform to inspect a Listing.
• NearUni Charges: The service fee NearUni collects from Students in addition to rent and any Agent-imposed fees.

2. Eligibility

• Students must be at least 16 years old to create an account.
• Users under 18 confirm that a parent or guardian is aware of and supports their use of the Platform.
• Agents must be at least 18 years old and complete NearUni's identity verification process before listings are published.
• All users must provide accurate, current, and complete registration information.

3. Nature of the Service

NearUni is a marketplace and verification platform. We are not a landlord, letting agent, or party to any tenancy agreement between a Student and an Agent.

Our role includes:

• Reviewing and verifying listings before publication
• Verifying agent identity
• Facilitating communication and inspection bookings
• Providing a platform for secure, trackable payment of applicable fees

Verification reflects the condition and information available at the time of inspection and does not guarantee future property condition, availability, or pricing.

4. Bookings and Inspections

• Students may request inspections through the Platform.
• A booking does not obligate a Student to rent a property.
• A booking does not require an Agent to reserve a property unless agreed directly between the parties.
• Students are encouraged to physically inspect a property before making any payment.
• NearUni is not responsible for missed appointments or changes arranged outside the Platform.

5. Payments and Fees

Each listing may include:

• Base rent set by the Agent
• Agent-imposed agency or administrative fees
• NearUni Charges

The total amount payable is displayed before payment. NearUni Charges are separate from rent and compensate NearUni for verification, platform access, and inspection facilitation services.

Subsequent rent renewals are generally paid directly in relation to the Agent's rent amount and do not include repeated NearUni Charges unless otherwise stated.

6. Refund Policy

NearUni Charges are generally non-refundable once an inspection has been successfully completed and the listing matches its description.

Refunds may be granted where:

• A listing is fraudulent or materially misrepresented
• The Agent cancels or becomes unavailable through no fault of the Student
• NearUni determines that a refund is warranted after review

Disputes regarding rent or Agent-imposed fees should first be raised with the Agent directly. NearUni may assist in mediation but is not obligated to refund amounts collected by an Agent.

7. User Conduct

You agree not to:

• Post false, misleading, or fraudulent information
• Harass, defraud, or discriminate against other users
• Circumvent NearUni's verification process
• Use another person's account or impersonate any individual or entity
• Scrape or misuse listing data for unauthorized commercial purposes
• Upload content for a property you do not have the legal right to list

8. Reporting Listings

If you believe a listing is fraudulent, inaccurate, unavailable, or otherwise problematic, you may report it through the Platform. NearUni may suspend or remove a listing while it is being investigated.

9. Agent Obligations

• Agents must have the legal right to list and let the property submitted.
• Listing information, including price, availability, photos, and amenities, must remain accurate and up to date.
• NearUni may remove listings or suspend agent accounts that violate these Terms or involve fraudulent or misleading conduct.

10. Intellectual Property

All content on the Platform, including the NearUni name, logo, design, software, and branding, is the property of NearUni or its licensors and may not be copied, reproduced, or used without prior written consent.

11. Third-Party Services

The Platform may integrate with third-party services such as payment providers, Cloudinary, WhatsApp, Instagram, and X. Your use of those services is governed by their own terms and privacy policies.

12. Disclaimers and Limitation of Liability

• The Platform is provided on an "as is" and "as available" basis.
• NearUni does not guarantee uninterrupted, error-free, or completely secure service.
• NearUni is not liable for disputes with Agents, property condition changes after verification, or funds paid directly to an Agent outside the Platform.
• NearUni's total liability shall not exceed the total NearUni Charges paid by the user during the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold NearUni harmless from any claims, damages, or expenses arising from your breach of these Terms, misuse of the Platform, or violation of any law or third-party right.

14. Termination

NearUni may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved, the dispute may be referred to arbitration in Lagos, Nigeria, or to the courts of Lagos State.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email where practicable. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
